These Terms of Service ("Terms") govern your access to and use of Asia Love's website, mobile applications, and services (collectively, the "Services"). These Terms form a legally binding agreement between you and Asia Love ("we," "us," or "our") regarding your use of the Services. By accessing or using our Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not access or use our Services.

These Terms incorporate by reference our Privacy Policy, Community Guidelines, Cookie Policy, Refund Policy, and any other policies or guidelines posted on our Services. You must be at least 18 years old to create an account or use our Services. By creating an account, you represent and warrant that you are at least 18 years of age. If we discover or suspect that you are under 18 years old, we will immediately terminate your account.

3.2 Account Creation

When creating an account, you must provide accurate, current, and complete information. You agree to update your information as necessary to maintain its accuracy. We reserve the right to suspend or terminate your account if we have reason to believe that the information you provided is inaccurate, outdated, or incomplete.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

1) Choose a strong password and keep it confidential

2) Not share your account credentials with any third party

3) Notify us immediately of any unauthorized use of your account or other security breaches

4) Log out of your account at the end of each session when accessing the Services on a shared device

3.4 Account Restrictions

You may only maintain one active account. Creating multiple accounts or allowing others to use your account is prohibited and may result in the immediate termination of all associated accounts.

4.1 Basic Services

Asia Love provides a platform for individuals to connect with others for the purposes of building relationships, friendships, and meaningful connections. We provide both free and premium features as part of our Services.

4.2 Premium Services

Premium Services are available for purchase and include enhanced features such as unlimited messaging capabilities and full access to messages from all members. Free members may have limited messaging and reading capabilities unless interacting with Premium members. Specific limitations and features of Premium Services are described where such services are offered for purchase.

4.3 Service Availability

While we strive to make our Services available at all times, we do not guarantee that the Services will be available on an uninterrupted, secure, or error-free basis. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice or liability.

4.4 Mobile Services

When you access our Services through a mobile device, your wireless service carrier's standard charges, data rates, and other fees may apply. You are solely responsible for any costs you incur to access the Services through your mobile device. You are also responsible for ensuring that your use of the mobile application complies with your wireless service agreement.

5.1 General Requirements

You agree to use our Services in accordance with these Terms, our Community Guidelines, and all applicable laws and regulations. You are solely responsible for your conduct and any User Content you submit, post, or display on or through the Services.

5.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

1) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

2) Harass, stalk, intimidate, abuse, defame, or threaten other users

3) Post or transmit any content that is unlawful, fraudulent, discriminatory, or offensive

4) Solicit money from, or defraud, other users

5) Use the Services for any illegal purpose

6) Post or transmit any unauthorized advertising, promotional materials, spam, or any other form of solicitation

7) Attempt to access, tamper with, or use non-public areas of the Services

8) Interfere with or disrupt the Services or servers connected to the Services

9) Create multiple accounts or allow others to use your account

10) Use automated systems or software to extract data from the Services

6.1 Content Responsibility

You retain ownership of any intellectual property rights you hold in User Content you post on or through the Services. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content.

6.2 Content Standards

All User Content must comply with these Terms and our Community Guidelines. You represent and warrant that:

1) You own or have the necessary rights to share your User Content

2) Your User Content does not violate the rights of any third party

3) Your User Content does not contain any material that is defamatory, obscene, offensive, or otherwise inappropriate

4) Your User Content complies with all applicable laws and regulations

6.3 Profile Pictures and Photos

Any photographs or illustrations containing human subjects that are uploaded to the Services must be of the user themselves. Group photos must have the explicit consent of all individuals pictured and must feature the user as the primary subject. Profile pictures do not need to be photographs but must comply with our Community Guidelines. For detailed requirements regarding photos and illustrations, please refer to our Community Guidelines.

6.4 Monitoring and Removal

We reserve the right, but are not obligated, to monitor, review, screen, delete, or remove User Content at any time and for any reason without notice. We may remove or refuse to post any User Content that violates these Terms or our Community Guidelines.

7.1 Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect your personal information when you use our Services. By using our Services, you agree to our collection, use, and sharing of information as described in our Privacy Policy.

7.2 Data Processing

We process your personal data in accordance with applicable data protection laws. By using our Services, you acknowledge and agree that your personal data may be transferred to and processed in countries other than your country of residence.

7.3 Communications

2) Full access to messages from all members

8.2 Payment Terms

When you purchase Premium Services, you agree to pay all fees and charges associated with your subscription at the rates in effect when the charges were incurred. Unless otherwise stated:

1) All fees are quoted in the currency specified at the time of purchase

2) Payments are non-refundable except as specified in our refund policy

3) You are responsible for any applicable taxes

4) Subscription fees will be billed at the beginning of each subscription period

8.3 Subscription Management

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. If you cancel, you will continue to have access to Premium Services until the end of your current billing period.

9.1 Account Termination by You

You may terminate your account at any time by following the instructions in your account settings. Upon termination:

1) Your profile will be removed from our Services

2) You will lose access to all messages and connections

3) Any unused portion of Premium Services will be forfeited

4) These Terms will continue to apply to any information we retain

9.2 Account Termination by Us

We reserve the right to suspend or terminate your account at any time and for any reason, including but not limited to:

1) Violation of these Terms or our Community Guidelines

2) Engaging in prohibited activities

3) Creating multiple accounts

4) Providing false or misleading information

5) Extended periods of inactivity

6) Upon receipt of reports of harmful behavior

7) As required by law or regulation

9.3 Effects of Termination

Upon termination of your account:

1) You will no longer have access to your account or any content within it

2) We may retain your information as required by law or for legitimate business purposes

3) Sections of these Terms that by their nature should survive termination will remain in effect

10.1 Service Provided "As Is"

The Services are provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the operation of the Services or the information, content, or materials included on the Services.

10.2 Member Verification Disclaimer

While we strive to maintain a safe platform, we:

1) Do not conduct criminal background checks on members

2) Cannot verify the accuracy of member profiles

3) Do not guarantee the conduct of members

4) Are not responsible for any interactions between members

5) Cannot guarantee the authenticity of any profile

10.3 Limitation of Liability

To the maximum extent permitted by law:

1) We shall not be liable for any indirect, incidental, special, consequential, or punitive damages

2) Our total liability for any claim arising from or relating to these Terms or our Services shall not exceed the amount you paid us, if any, in the twelve months prior to the action giving rise to liability

3) We are not liable for any loss of data, profit, opportunity, or goodwill

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

1) Your violation of these Terms

2) Your use of the Services

3) Your violation of any rights of another person or entity

4) Your User Content

5) Your interaction with other members

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belize, without regard to its conflict of law provisions.

12.2 Dispute Resolution Process

Before filing a claim against us, you agree to:

1) Contact us and describe the issue

2) Allow us 30 days to respond and attempt to resolve the issue

3) Participate in good faith discussions to resolve the dispute

12.3 Arbitration

If we cannot resolve a dispute through the process above, any dispute arising from or relating to these Terms or the Services shall be finally settled by binding arbitration, except that either party may bring an individual action in small claims court.

12.4 Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and us regarding your use of the Services.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms at any time without notice or consent.

Users are entitled to request a refund within 14 days of their initial purchase ("grace period"). After this grace period, we are not obligated to fulfill any refund requests, including partial refunds for unused portions of membership. By accepting these Terms, you acknowledge and agree to our complete Refund Policy.

By registering an account, you explicitly consent to non-essential data processing for marketing, analytics, and monitoring purposes. This includes data acquired through website interaction and other mediums as detailed in our Privacy Policy. While our Cookie Policy currently limits us to essential first-party cookies, you acknowledge and consent that we retain the right to use other monitoring mediums for non-essential purposes upon account registration.
